Definitions
  • Terms of Service - this document
  • Service - an Internet service belonging to the Service Provider, under which the Service Provider provides Services
  • Password - an implicit string of characters determined by the Service Recipient to guarantee the authorized access to the Service
  • Account - a collection of resources and settings created by the Service Recipient as a part of the Service. The Service Recipient may use the Account to manage the Services available in the Service
  • Services - Services provided by the Service Provider to the Users and Service Recipients based on Terms of Service
  • Service Provider - a natural person represented by Mateusz Wyczawski
  • Service Recipient - A User who has an Account and uses the Services provided electronically by the Service Provider
  • User - it should be understood as a natural person with full legal capacity or a natural person who, due to limited legal capacity, is represented for the purposes of accepting Terms of Service by statutory representatives or legal guardians. The User may also be a legal person or an organizational unit that is not a legal person, which the law grants legal personality, and which uses the Services provided by the Service Provider
General Provisions

These Terms of Service govern the use of the Footlify application ("Service"). Please read the terms of this agreement carefully before registering.

By entering into this Agreement and / or using the Service, or by accessing the Service, you expressly accept these Terms of Service and all its terms and conditions and agree to be bound by them. By accepting this Agreement:

  • you confirm that you have read and understood these Regulations
  • you agree to all of its provisions
  • you agree to be legally bound by this Agreement

If you do not agree to the terms of this Agreement, you may not use or access the service.

Account Registration

Access to the application is possible only after correct Account Registration and its verification. Registration takes place by completing the registration form, in which you must provide your name, surname, email address, country of birth, password, gender, account type, confirm the acceptance of the regulations and then click the "Sign up" button. Then, an activation link will be sent to the e-mail address provided by the Service Recipient (within a few minutes), which must be clicked to activate the account.

Your chosen Password should be reasonably difficult for third parties to guess. To ensure greater security, we require the Password to consist of at least 8 characters with at least 1 number and one uppercase and lowercase letter.

Please be careful to protect your password from misuse by others and notify us immediately of any misuse.

You are personally responsible for the use of the Service through your Account. You agree to enter and keep true, accurate, complete and current information in your Account and that we can rely on the information in your Account.

Data Deletion

To do this, log in to the application and then go to the appropriate tab in the settings. Then perform all the steps that appear on the screen. Then, a confirmation message will be sent to your e-mail address, in which you must click the link to delete the account.

If you use several sub-accounts under one Account (e.g. as a coach and as a player), this option should be performed for each sub-account separately. Only then will all your data be removed from our Service.

We would like to mention that with complete deletion of the Account, we will not be able to restore your data to the state it was in before deletion. Therefore, please make a careful decision when deleting your Account.

Using the Service

Using the portal is possible only after logging in (and prior Account verification). Each type of user has different features that may not be available in other types of Account.

The user is obliged in particular to:

  • use the application in a way that does not interfere with its functioning
  • use the application in a manner consistent with its intended use and respecting the Regulations
  • using the application in a way that is not inconvenient for other Users
  • use the application in such a way that it is not possible to obtain information not intended for the User
  • not to take actions aimed at breaking security, the authentication / authorization system or any other form that interferes with the proper operation of the application
  • compliance with the rules commonly used in society

In the event of breaking the regulations, we may suspend your Account for a certain period of time. If you are not able to use the application, you will not be entitled to a refund of the paid Account fee for the period in which it was suspended.

Technical Breaks

There may be situations where access to the application may be difficult or impossible. This may be related, for example, to changes in the portal or for reasons beyond our control.

We will make every effort to ensure that technical breaks dependent on us take place at night and last as short as possible.

We are not responsible for situations beyond our control (e.g. for problems on the part of third parties).

You can notify us of copyright infringement by sending an e-mail with the subject "Copyright Infringement" to the following address: support@footlify.freshdesk.com

Your message must:

  • identify the original copyrighted work that has been infringed;
  • identify content on the Service that you believe infringes the copyright of a copyrighted work. Please provide us with enough details so that we can locate the allegedly infringing content on the Service;
  • provide your contact details, including your name, mailing address, telephone number and e-mail address, if available;
  • make a statement that you have a good faith belief that use of the content in the manner complained of is not authorized by the copyright owner, its agent, or the law; contain a statement: "I swear, under penalty of perjury, that the information in this notice and complaint is accurate and that I am the copyright owner or am authorized to act on behalf of the copyright owner that has been infringed."; and include your signature if necessary.
Fees

At the moment, the portal is completely free, so all users have access to all functionalities. However, there are also plans to introduce a paid Account, thanks to which users with such an Account will have access to all functionalities, while those with a free one may lose access to some functionalities of the application, even if access to them was previously unlimited.

Ads

Ads may appear in the app that will only be displayed for free accounts.

Complaints

Complaints related to the provision of Electronic Services via the application may be submitted by the User via e-mail to the following address: support@footlify.freshdesk.com .

In the e-mail, please provide as much information and circumstances as possible regarding the subject of the complaint, in particular the type and date of irregularities and contact details. The information provided will significantly facilitate and accelerate the consideration of the complaint by the Service Provider.

The Service Provider considers the complaint immediately, not later than within 14 days. The Service Provider's response to the complaint is sent to the Customer's e-mail address provided in the complaint or in a different manner provided by the Customer.

Changes to the regulations

These regulations may be changed at any time without prior notice. In the event of introducing significant, negative changes to the Regulations, it will be announced in a separate notification informing about the changes.

The User is responsible for regularly checking the Regulations. By continuing to use the Service, you consent to any changes and modifications.
